Terms of Service

1. Acceptance of Terms

By accessing or using ExporterProfile.com ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. These terms apply to all users, including exporters who subscribe to the Platform and visitors who browse the public-facing pages.

2. Description of Service

ExporterProfile provides Indian exporters, manufacturers, and traders with a hosted export website platform including product catalog management, multilingual content publishing, RFQ (Request for Quotation) management, and associated services. The Platform is provided on an annual subscription basis.

3. Subscriptions and Payment

Subscriptions are annual. Payment is due at the beginning of each subscription period. GST at the prevailing rate (currently 18%) is charged additionally on all subscription fees. A GST invoice is provided for all payments.

Founding member pricing, where applicable, is locked at the rate agreed at signup and will not increase for the duration of the subscriber's continuous subscription. Pricing lock is forfeited upon cancellation and re-subscription.

4. Content Ownership

All content you provide — including product descriptions, company information, images, certifications, and related materials — remains your property. You grant ExporterProfile a non-exclusive licence to display this content on your profile for the purpose of operating the Platform. Your content is always exportable and will never be sold to third parties.

5. Acceptable Use

You agree not to use the Platform to:

• Publish false, misleading, or fraudulent business information
• Represent certifications or compliance documents you do not hold
• Collect or harvest buyer information for purposes outside the Platform's intended use
• Violate any applicable Indian or international export regulations
• Engage in spam, phishing, or any unsolicited communication through the RFQ system

6. Service Availability

ExporterProfile aims for high availability but does not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. Unplanned outages will be resolved as quickly as practicable. Subscription fees are not prorated for downtime except in cases of extended outages exceeding 72 consecutive hours.

7. Cancellation and Refunds

Subscriptions may be cancelled at annual renewal. Cancellations do not entitle subscribers to a refund for the current subscription period. Upon cancellation, your profile will remain accessible in read-only mode for 30 days, during which you may export your content. After 30 days, your profile data will be deleted from our servers.

8. Limitation of Liability

ExporterProfile is not liable for any loss of business, loss of revenue, or other consequential losses arising from use or inability to use the Platform. Our total liability in any matter is limited to the subscription fees paid in the 12 months preceding the event giving rise to the claim.

9. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

10. Changes to Terms

We may update these Terms from time to time. Subscribers will be notified of material changes by email at least 30 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
